Terms and Conditions
The seller is Broadoak Direct Ltd to whom all payments become due for goods and services provided.
The purchaser is the individual, company, or firm from whom an order has been accepted and who becomes responsible for payment for all goods and services provided.
The price is to be paid as specified in the quotation and a part payment is to be made by the purchaser and accepted by the seller on placement of the order.
In the event of non payment by the purchaser at the due date, the seller reserves the right to withhold delivery until payment can be made and has the right to charge 2% per month on any monies due, calculated on a daily basis. The seller also has the right to charge an additional delivery cost, all of which the customer agrees to pay.
The goods shall be at the risk of the purchaser following delivery. Notwithstanding delivery, title in the goods shall not pass to the purchaser until the purchaser has made payment of all sums owing to the seller. Until such time as title in the goods passes to the purchaser the seller shall have the right to repossess or otherwise recover the goods.
The seller shall not be liable for any default due to circumstances beyond reasonable control of the seller including, but not limited to, Acts of God, war, fire, flood, and the shortage of supply or failure to deliver of our suppliers.
All orders and any dispute arising there from shall be governed by English law and subject exclusively to the jurisdiction of the English courts.
Nothing in these conditions shall affect the statutory rights of a consumer.
Deliveries
Deliveries of heavy items are to the kerbside - for items like worktops, the drivers will need help unloading and are normally quite helpful in carrying things from the lorry to your home. However, do not expect them to carry goods up several staircases into flats. You will also need to ensure that there is good access for large lorries to your home, for instance removal type lorries. If not, you must tell us in case we need to make special arrangements for a smaller lorry to deliver to you. We will normally despatch goods in agreement with yourself. When you place an order, we will call you to confirm the delivery arrangements are acceptable to you before processing your payment. Please remember that if we have arranged a delivery with you and you can’t accept the delivery or amend the delivery details without giving us sufficient notice of the change, we may need to charge you for the aborted delivery. NOTE: This charge would be the actual cost of delivery which may be more than the standard deliivery charge. This is due to the fact that many of our delivery charges are subsidised within the cost of the product. We advise that you do not book fitters until after you have received delivery as we cannot accept responsibility for delays.
Our products are sent through a number of delivery systems ranging from envelopes with the Royal Mail to specially arranged point to point deliveries by articulated lorry. Thus, it is very hard for us to say here when you can expect delivery.
Before accepting your order, we will confirm you will be at home to receive the delivery. We cannot say for certain what time in the day these deliveries will arrive. For most deliveries we are able to call the drivers on the day of delivery and get an estimate of timescale.
Amendments to Orders
Should you need to make changes to or cancel an order you have already placed with us, we will do our best to stop the order and refund all the money you have paid. However, depending on the product, we may not be able to stop an order once it has been accepted and, in these cases, you will be liable for the full payment.
Cancelling your Order and Returns
Under the Consumer Protection (Distance Selling) Regulations 2000 you may cancel your order at any point up to 7 days after receiving delivery and we will give you a full refund, less costs associated with the return. However, many of our products are exempt from this legislation and cannot be returned. You should contact us first by e-mail or phone to arrange the return of a product. Please remember:
1. Many of our products are modified or manufactured on receipt of your order. These items cannot normally be cancelled once work has begun and you will be liable for the full cost of the product;
2. Any goods you wish to return must be in their original packaging, unused and undamaged. If you return the goods you must insure them against carrier damage. You are responsible for the safekeeping of goods until they are received by us, or collected by our agents;
3. Some products have no easy way of arranging returns, for example, the cost of collecting and handling laminate worktops is higher than the cost of the worktops. As you are responsible for the cost of returning the product it may not be in your interest to return them;
4. Larger packaged items like kitchen cabinets and doors, appliances, sinks, some taps would all need detailed inspection on return for missing parts and there will be a charge for this.
